De Proteïne Winkel| Terms and Conditions

ARTICLE 1 APPLICABILITY AND CONDITIONS

These general sales conditions apply to each offer presented by De Proteïne Winkel to consumers (every natural person obtaining or using products or services offered to the market for non-professional purposes only). To be allowed to place an order, consumers must be at least 18 years old. If it appears that an order is placed by a minor as defined by European law, this order can be refused. If, next to these general sales conditions, additional special conditions would apply, the above also applies to these special conditions. If the general sales conditions would conflict with these special conditions, consumers can always appeal to the most favourable text to their benefit. The placement of an order on the website implies the explicit acceptance of these general sales conditions, which can be consulted on the website at all times.

ARTICLE 2 OFFER AND ORDER

If an offer has a limited term of validity or is subject to certain conditions, this is explicitly mentioned in the offer. All offered goods are described as completely and accurately as possible. The description will at the very least be sufficiently detailed to allow consumers to make a proper assessment of the offer. If pictures are used, these will represent a truthful depiction of the offered goods. An order placed by a consumer is complete and the agreement between De Proteïne Winkel and that consumer final, as soon as De Proteïne Winkel has received the approval of the card issuer for the payment transaction by credit or debit card. De Proteïne Winkel accepts Bancontact/Mister Cash, Paypal, Visa, MasterCard, Maestro, and payment by bank transfer. If the card issuer refuses to approve the payment to De Proteïne Winkel, De Proteïne Winkel cannot be held responsible for delays in the delivery and/or the non-delivery of the order. Orders without valid payment by the registered card holder are not accepted or processed.

ARTICLE 3 RIGHT OF WITHDRAWAL

Consumers are entitled during a period of 14 days as from the delivery not to keep the goods (right of withdrawal). Consumers are then allowed to return the order without paying a fine and without being due any motivation. De Proteïne Winkel will repay the full purchasing price within 14 days after the goods are received and checked by De Proteïne Winkel, by way of international bank transfer (customer should provide their BIC and IBAN numbers). De Proteïne Winkel is entitled to suspend repayment until it has received the goods or until the consumer has shown that the goods have been returned, depending on which of both events takes place first. Goods must be returned to De Proteïne Winkel in their original packaging. They may have been unpacked or handled to the extent as needed to assess whether or not the consumer wants to keep them. The external sleeve (with logo) around the lid must be intact and the internal seal of the can unopened. Delivered goods can be returned by post or courier or a request for the courier used for delivery can be made via De Proteïne Winkel (submit request to info@deproteinewinkel.com).

ARTICLE 4 PRICE

During the period mentioned in De Proteïne Winkel's offer, prices will not change subject to price changes following changes to the applicable VAT rates. Prices are inclusive of all taxes, VAT, and services. Shipping costs are charged according to the rates communicated prior to the final submitting of the order.

De Proteïne Winkel reserves itself the right to cancel and refund orders if a price is incorrectly displayed on the webshop. The customer will be notified by email and the amount will be refunded immediately.

ARTICLE 5 PAYMENT

We only accept payment through the payment modules that are available on our website. To warrant safe online payments and the security of personal data, all transaction data are sent through the internet in encrypted form using SSL technology.

ARTICLE 6 CONFORMITY AND WARRANTY

De Proteïne Winkel warrants that the goods comply with the order, observe all prevailing laws and regulations and meet the normal expectations that consumers may have according to the product specifications. If goods delivered by De Proteïne Winkel have been damaged during transport, do not match with the articles mentioned on the delivery note or do not comply with the articles ordered by the consumer, the latter must report this as soon as possible and within 3 days at the latest, and return the articles within 14 calendar days after their reception. Consumers can have products replaced free of charge but without being entitled to any compensation (for damage) whatsoever.

ARTICLE 7 DELIVERY AND EXECUTION

All goods are delivered at the address indicated by the consumer in question at the time of the order. When an article is available in stock, it will be offered within 1 to 4 working days. If De Proteïne Winkel cannot deliver in time, the consumer in question will always be informed prior to the expiry of the pre-set delivery term. De Proteïne Winkel can by no means be made liable for the loss or late delivery of a package that must be sent by post. In such event, De Proteïne Winkel will do everything possible to retrieve and deliver the package as soon as possible. De Proteïne Winkel cannot be made liable for any consequential damage on account of a late delivery or the non-delivery by the courier engaged by the company. De Proteïne Winkel's liability will in such events remain limited to the value of the articles for which it is shown that these were not delivered to the customer.

ARTICLE 8 INTELLECTUAL PROPERTY

The website, logos, texts, photographs, names and, in general, all communication from De Proteïne Winkel are protected by intellectual property rights owned by either De Proteïne Winkel or its suppliers or other rightful claimants. It is not allowed to use and/or make changes to the intellectual property rights as described in this article. For instance, drawings, photographs, names, texts, logos, colour combinations, etc. may not be copied or reproduced without De Proteïne Winkel's prior and explicit written consent.

ARTICLE 9 PRIVACY

De Proteïne Winkel commits itself to use your data solely for the execution of the present agreement entered into by consumers through the order and to send information about De Proteïne Winkel free of commitment. De Proteïne Winkel will treat consumer data as confidential data, such in accordance with the detailed privacy statement that can be consulted on www.deproteïnewinkel.com. De Proteïne Winkel strictly respects the Belgian Act of 8 December 1992 regarding the protection of privacy and the processing of personal data.

ARTICLE 10 CHANGES TO THESE GENERAL SALES CONDITIONS

De Proteïne Winkel reserves the right to change these general sales conditions at any time convenient. All amendments to these general sales conditions will be disclosed online.

CUSTOMER SERVICE AND DISPUTES

The customer service of De Proteïne Winkel can be reached by e-mail info@deproteinewinkel.be De Proteïne Winkel will do everything possible to handle questions or complaints within 48 hours. All agreements entered into by De Proteïne Winkel with consumers, regardless of their place of residence, are subject to Belgian law only and disputes will be submitted to the Belgian competent courts only. If for reasons of international law another law would apply, the interpretation of the current general sales conditions will be based primarily on the Belgian Act on Market Practices and Consumer Protection.
